Conditions of Use Agreement for LeTourneau University Aspects of Wheelchair Mobility Tests (AWMT)



Public users are not required to seek permission to use the Aspects of Wheelchair Mobility Tests (“AWMT”) posted on our website. However, by using the AWMT, you expressly agree to this Conditions of Use Agreement. Please read and review these conditions carefully before accessing or using the AWMT. By accessing or using the AWMT, you acknowledge that you have read, understood and agreed to the Conditions of Use Agreement.  If you do not agree to the Conditions of Use, you may not access or use the AWMT.

  • The AWMT and any other associated materials are being provided to you under a limited license agreement, subject to the terms stated herein. The license may be revoked at any time, for any reason.
  • This license allows you to use a copy of the materials for your personal use.
  • You may not sell, rent, lease, lend, sub-license, charge a fee for use, or otherwise commercially exploit the AWMT material in any way, without the written permission of LeTourneau University (LETU).
  • You may not place the AWMT material on a website.
  • You must use these materials in accordance with the ethical and integrity standards required by your jurisdictions.
  • Alternative or derivative use of AWMT material may only be carried out with the written permission of LETU.
  • AWMT materials may be copyright protected.
  • In any written material arising from your use of the AWMT, you agree to acknowledge LETU as the author.
  • For any modified version of the AWMT materials (e.g. for a research project), the original version must be cited and the modifications must be explicitly described.
  • Where a conflict arises between private and public interests, you are expected to take the necessary measures to ensure that the public interest is protected.
  • You agree that your access to and use of the AWMT is at your own risk. LETU disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. LETU makes no warranty as to the quality, suitability, completeness, or error-free nature of the materials. Neither LETU nor any party involved in creating, producing or delivering this material shall be liable for any damages, including, without limitation, direct, incidental, consequential, indirect or punitive damages, arising out of access to, use of or inability to use, the AWMT or related material.
  • The AWMT may contain references to medical conditions and/or their treatment. Any such information is not meant to be a substitute for advice provided by a qualified health care professional. Patients should not rely upon information provided in the AWMT for diagnosing a medical condition or disease. Patients should always consult with a doctor or other health care professional for medical advice about diagnosis and treatment.
  • You agree to indemnify, defend and hold harmless LETU, its officers, directors, faculty, employees, agents, and third party partners from and against any losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your use of the AWMT, or your violation of these Conditions of Use.
  • Your use of the AWMT is subject to any applicable federal, state or other laws of your jurisdiction, including, without limitation, those protecting the privacy of a patient’s medical condition or records. All information collected through your use of the AWMT must be maintained in strict confidence, and used only for the purpose for which it was originally collected. AWMT data must be stored in a secure manner to prevent unauthorized access, and must be transmitted using secure techniques. When such data is no longer required, it must be destroyed in a secure manner.
  • If the AWMT is used for research purposes, the research must have been approved by a Research Ethics Board or Institutional Review Board in the user's jurisdiction.
  • Any translation of the AWMT, or these Conditions of Use, not provided by LETU is the responsibility of the local user. In the event of a dispute, the English version of such documents shall govern.
  • Your rights under this license will terminate automatically, without notice, if you fail to comply with any of the Conditions of Use herein.  
  • This Conditions of Use Agreement and your use of the AWMT shall be governed by the laws of the United States of America and the State of Texas, without regard to its conflicts of laws principles. Any legal proceeding related to the AWMT and related materials shall be brought exclusively in a federal or state court of appropriate jurisdiction and venue sitting in Texas.
  • If any provision of this Conditions of Use Agreement is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions. LETU reserves the right to alter or delete materials from this web site at any time at its discretion.
